Welcome to the privacy policy (“Privacy Policy”) of the Curacao Travel Guide mobile application (“App”) of the Curaçao Tourism Development Foundation (doing business as Curaçao Tourist Board, “CTB” or “we”). In providing you with this App, we process personal data. CTB is the data controller regarding the processing of your personal data by using this App. Protecting your personal data while it is in our care is both an honor and a great responsibility. We have provided the information below to help you understand how your personal data may be collected, used, stored, and shared (“processed”) by CTB, and how to exercise your choices with respect to your personal data. 1. The personal data we process
When you interact with our App, we may collect personal data about you in the following ways: directly from you; through automated technologies such as cookies; and from other sources, such as our business partners and data processors. We do not process sensitive personal information.
We will use the information we receive only for the purposes that are described in this Privacy Policy or that are otherwise made clear to you in the App. Please note that we do not control, and are not responsible for, other uses of your personal data by your third-party social media provider. We recommend that you review their privacy policy to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.
We may process the following personal data, depending on how you interact with the App, for the following purposes and on the grounds of the following legal bases:
In addition, we may use your personal data for other purposes that we may notify you of from time to time where we have a legitimate business interest, your prior consent, or another lawful basis to do so.
CTB may aggregate or de-identify information so that it can no longer identify you. Subject to applicable laws, CTB may use this aggregated or de-identified information for analytical purposes, such as developing and improving our products and services, identifying industry trends and developments, and benchmarking.
2. Sharing of your personal data
We may share your personal data as follows:
Within CTB. We may share your personal data with CTB departments for the purposes described in section (1.) above “The personal data we process”.
With our service providers. We may share your personal data with service providers that perform services on our behalf, including website and platform hosting, editing, analytics, content management, and marketing services. Before we share your personal data with any service provider, they must agree to comply with applicable laws, maintain strong data security, and only process personal data as we instruct. In all other respects, CTB will not provide your personal data to third parties, unless with your prior consent or in the case of a legal obligation.
3. Cross-border transfers
If we transfer your personal data, for example out of the European Economic Area (“EEA”), we implement appropriate safeguards in accordance with applicable law (such as the General Data Protection Regulation) and will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. We will not transfer your personal data to a country unless there are adequate controls in place, including the security of your data and other personal information.
4. Retention of your personal data
We retain your personal data for as long as necessary to carry out the purposes described in this Privacy Policy and any additional period that may be required by law.
5. Cookies and other tracking technologies on our App
We use tracking technologies on the App, such as cookies, beacons, and pixels, for the purposes described in section (1.) above “The personal data we process” and hereinafter.
Cookies
Cookies are small text files which are stored by the App on the device you use to visit the App. This way your (personal) data can be collected.
We use the following cookies:
· Session cookies that are temporary and expire when your session on the App is over or when you close the App.
· Persistent cookies that remain on your device until they reach their expiration date, or you clear them from the App.
· Strictly necessary cookies that are essential for the operation of the App and allow you to navigate the App and use its features.
· Performance cookies to monitor performance of the App and your interactions with the App to compile anonymous statistical data for internal analytics and improve the App functions.
· Functionality cookies that allow the App to remember your preferences to increase the operation and your ease of use of the App
· Targeting cookies to compile data based on your interaction with the App and your preferences to provide you with personalized news, advertisements and general information.
You can accept all cookies, disable them, or choose to be notified when a cookie is being stored. However, some of the features of the App may not work properly if the cookies are disabled.
Beacons
Beacons support one-way communications from us to you and only transmit signals.
The bluetooth signal of your device is used to determine the proximity. With the use of the beacons, we are able to send you notifications regarding the area where you are located.
Push notifications
Push notifications are clickeable pop-up notifications that appear on your device.
Push notifications are sent using the geo location of your device on which the App is installed. With push notifications we can inform you about updates to the App, news, offers and general information.
6. Security of your personal data
The security, integrity, and confidentiality of your personal data is important to CTB. We store most information about you in computer systems and databases operated by us or our service providers. Some information about you is recorded in paper files that we store securely. We have implemented technical and organizational security measures that are designed to protect personal data throughout our systems from unauthorized access, disclosure, use, and modification or loss. Our employees are bound to confidentiality and are obligated to follow our instructions concerning adequate protection of your personal data. We regularly review our security procedures to consider appropriate new technology and methods. Please be aware that, despite our best efforts, no security measures are perfect or impenetrable.
7. Links to third-party websites
CTB’s services may include links to third-party websites and applications of interest, not owned by CTB. When using such links, please be aware that any third-party website is subject to its own privacy and data protection policies and is not covered by this Privacy Policy. CTB is not responsible for the handling of your personal data by third parties or for the cookies used on these third-party websites. Please refer to “The personal data we process” section 1 for our use of your personal data through social media logins.
8. Policy for Children
If you are a minor under applicable law, you should not use CTB’s sites or services for any purpose without first obtaining consent from your parent or guardian. We do not knowingly collect, use, or disclose information from or about a child under 13 years old without the prior consent of their parent or guardian. If you would like to review any personal data that we have collected online from your child, request to delete such information, request that there be no further collection or use of your child’s information, or if you have questions about these information practices, you may contact us at info@curacao.com.
9. Rights regarding personal data
You have the right to request to:
- receive an answer on whether personal data that concerns you will be processed or not, and, if it will, the right to access such data;
- receive an electronic copy of the personal data we have about you;
- rectify any errors in your personal data;
- delete your personal data;
- restrict or object to the processing of the personal data about you;
- withdraw consent to the processing of your personal data if the processing is based on consent;
- forward your personal data to an organisation of your choosing, in a structured, customary, and machine-readable form, and to the extent you yourself provided said personal data to the controller; and
- not be subject to a decision based on a solely automated processing, including profiling, of your personal data that has legal effects or that affects you in a different way to a considerable degree.
If you submit a request which cannot be fully or partially fulfilled for legal or technical reasons, an explanation for this limitation will be provided. You also have the right to lodge a complaint with a supervisory authority. In Curaçao, this supervisory authority is the College Bescherming Persoonsgegevens.
To exercise your rights, you may submit a request to us by email at info@curacao.com. Only you, your authorized representative, or you on behalf of your minor child may submit a request. For the protection of all individuals’ personal data, we will only process your request if we can reasonably verify that you are, or are the authorized representative of, the person whose personal data we hold.
If at any point you wish to review or change your preferences regarding marketing communications, you can use the “opt-out” or unsubscribe mechanism or other means provided within the communications that you receive from us, or submit an email request to info@curacao.com. Note that you may still receive transactional communications from CTB if you engage with our products or services. If you no longer wish to receive correspondence, emails, or other communications from third parties, you are responsible for contacting the third party directly.
10. Updates to this Privacy Policy
We periodically update this Privacy Policy. Any changes to the Privacy Policy will be posted on this page and will become effective as of the Effective Date above. If we make a material change in the way we collect, use, or share your personal data, we will post a prominent notice or provide other notice as required by law. We encourage you to periodically review this page for the latest information on our privacy practices.
