Curaçao Travel Guide App – TERMS OF USE

Welcome to the Terms of Use of the Curaçao Travel Guide mobile application (“App”) of the Curaçao Tourism Development Foundation (doing business as Curaçao Tourist Board, “CTB” or “we”).
Please read the Terms of Use carefully before using the App.
These Terms of Use govern the use of this App and the agreement between you and CTB pertaining thereto. These Terms of Use apply to all users who access or use the App and set out the rights and obligations of all users regarding the use of the App.
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms of Use. By using the App you accept and indicate, that you agree to all terms, conditions and notices, as contained on the App, as these may, from time to time, be amended by CTB, in its sole discretion.
If you disagree with any part of these Terms of Use, then you should not access the App.
Your access to and use of the App is also conditioned on your acceptance of and compliance with the Privacy Policy of the App. Our Privacy Policy describes our policies and procedures on the collection, use and disclosure of your personal data when you use the App and tells you about your privacy rights and how the law protects you. Please read our Privacy Policy carefully before using the App.
INTELLECTUAL PROPERTY
The content and information, displayed on the App, features and functionality are the property of CTB. All rights are reserved.
Reproduction, downloading, copying or (re-)distribution for commercial purposes of any materials and/or of design elements of or on this web site are strictly prohibited, without our prior written permission.
The App may contain documents, files, articles, trademarks, logos, icons, graphics and other copyrighted materials, owned by us and/or third parties and are protected by laws around the world. Use of materials, pertaining to any third party, may also require the permission to such use by such third party, of which permission you must avail yourself.
NO WARRANTIES
The App and all its content are provided "as is" and "as available" for your personal use only. The content of the App is provided without warranty of any kind, either express or implied with respect to the App, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or no infringement. We do not make any warranty or representation of any kind, as to the accuracy, completeness, currency or reliability of any content, available on or through the App. Your use of the App is at your sole risk. We do not warrant that the App will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, meet any performance or reliability standards or that the use of the App will be uninterrupted or without errors or that any errors or defects can or will be corrected. It is your own responsibility for taking all precautions, necessary to ensure, that the content you may obtain from the App is free of viruses or other harmful components.
LIMITATION OF LIABILITY
Under no circumstances shall we or any of our affiliates be liable for any direct, indirect, punitive, incidental, consequential or any other damages of whatever kind, that result from the use of the App or any information posted thereon and/or the inability to use the App, irrespective the basis of such damages (contract, tort, negligence or any other grounds), incurred by you or any third party, that relied on you.
INDEMNIFACTION
You accept, on our first request, to, on your own expense, defend and indemnify us and to hold us harmless from any and all liabilities, claims, demands, causes of action, costs and expenses, including attorney fees, which you, your heirs, representatives, executors, administrators or any other persons acting on your behalf or on behalf of your estate have or may have that arise from your use and/or misuse of the App. Your aforementioned obligation shall also apply with respect to any individual director or employee of CTB, as well as with respect to our successors and any third party, engaged by us, including assigns and licensees. We shall, at all times and at our sole discretion, be free to assume the exclusive defense on your behalf against and/or in connection with any such liabilities or claims, with the understanding that we are under no obligation, whatsoever, to any such assumption.
MODIFICATIONS
We reserve the right to make changes, corrections and/or improvements to the App, as well as to these terms and regulations and/or any other rules, that govern the use of the App, at any time. Any changes to the Terms of Use will be posted on this page and will become effective as of the Effective Date above.
If we make any material changes to the App, we will post a prominent notice or provide you with other notice as required by law. That which constitutes a material change will be determine by us at our sole discretion. By continuing to access or use the App after those changes become effective, you agree to be bound by such changes. If you do not agree to the new terms, in whole or in part, you must stop using the App.
You are encouraged to periodically review this page for the latest information on the Terms of Use.
VIOLATIONS OF RULES AND REGULATIONS
We reserve the right to seek all remedies available at law against violations of the rules, terms, conditions and regulations on the use of the App. This also includes the right to block access to the App from any particular device or internet address.

The App may provide links to third-party web sites or services as a convenience to users. These third-party web sites or services are not owned or controlled by us. The access to any other web sites or services, linked to the App, is at your exclusive risk only. We assume no responsibility for any content, of any such linked web sites or services.
You agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any third-party web sites or services. We strongly recommend you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
SEVERABILITY
These Terms of Use of the App constitute the complete agreement between you and CTB on your use of the App. If any provisions of these Terms of Use should be held by a court of law with competent jurisdiction to be invalid, the other terms and conditions shall maintain their validity.
GOVERNING LAW AND CHOICE OF FORUM
Any dispute with us, which may arise from or which is related to the use of the App and/or any information, obtained via the App, shall be governed, exclusively, by the laws of Curaçao, with the exclusion of any rules on the conflict of laws. Any of the disputes, referred to hereinabove, shall only be decided upon the Court of First Instance of Curaçao with the right of appeal and cassation.

Bienvenido/a a los Términos de Uso de la aplicación móvil Guía de Viaje de Curaçao ("Aplicación") de la Fundación para el Desarrollo del Turismo de Curaçao (conocida como Junta de Turismo de Curaçao, "CTB" o "nosotros").
Por favor, lee cuidadosamente los Términos de Uso antes de utilizar la Aplicación.
Estos Términos de Uso rigen el uso de esta Aplicación y el acuerdo entre tú y CTB relacionado con la misma. Estos Términos de Uso se aplican a todos los usuarios que acceden o utilizan la Aplicación y establecen los derechos y obligaciones de todos los usuarios con respecto a su uso.
